Community Club Covenants Compliance Process The covenants are a set of formal rules adopted by the homeowners to maintain the quality of life and property values in the Ken Lake neighborhood. Every homeowner signs a commitment to following the covenants when he/she purchases a house in the neighborhood. Compliance with covenants begins with personal responsibility and a friendly reminder from caring neighbors. The Covenants Compliance Committee assists by coordinating the compliance process below when compliance issues arise.
Informal Process 1. The Covenants Compliance Committee talks with the homeowner (or renter) regarding the covenant issue and confirms conversation in a written follow-up letter or record of date and proposed resolution. 2. If issue is not resolved within timeframe agreed upon, the Covenants Compliance Committee writes a letter to the homeowner reiterating the request to comply by a certain date AND outlines the formal steps for noncompliance below. 3. If the issue is not resolved by the date stated in the letter, the matter is referred to the Board.
Formal Process 1. The Board considers the issue and may approve sending a registered letter to the homeowner requesting compliance by a specified date. The letter outlines the consequences of not complying which can include a daily fine until the covenant is met. The Board may direct the Covenants Compliance Committee to write the letter, but it must be signed by a Board member who is indemnified by the Lakemoor Community Club. 2. If the issue is not resolved by the date stated in the letter from the Board, a daily fine is assessed and added to the homeowner’s dues until the covenant is met. The Covenants Compliance Committee will monitor the issue and notify the Lakemoor Community Club accountant of the start date for the fine. 3. If the homeowner refuses to pay the fine, the Lakemoor Community Club puts a lien on the home and continues to charge the fine. The lien is implemented when the homeowner’s account is in arrears for six months.
Appeal Process 1. The homeowner may appeal within 14 days of receiving the registered letter from the Board. The homeowner notifies the Board in writing of his/her intent to appeal. 2. No fine will be imposed until the appeal is heard by the Board. 3. The appeal will be on the agenda for the next Board meeting or a special Board meeting may be called. The homeowner is expected to attend. 4. The Covenants Compliance Committee will present the covenant noncompliance issue and the homeowner will respond. 5. The Board will determine the course of action. |
